Rental conditions

Rental

Rental is carried out according to the agreed rental period - daily rent, one day, multi-day rent, or weekly rent. Unused parts of the agreed rental period will not be refunded. The vehicle and other equipment can only be rented out upon presentation of a valid ID. In a group, it is sufficient for one person over 18 years old to identify themselves; this person is then responsible for the vehicle and equipment. For rental to persons under 18 years of age, approval from a guardian is required, which can be obtained, for example, through a phone call to Visby Bike Rental, providing contact information and approval. The vehicle and other equipment may only be used on Gotland. 

Pick-up

The vehicle and other equipment will be handed over at the selected pick-up location and at the chosen start time or at another agreed location within the rental location's opening hours.

Return

The vehicle and other equipment must be returned to the same location where they were picked up or to another agreed location within the rental location's opening hours at the end of the agreed rental period. If the return of the vehicle and equipment occurs after the rental location's opening hours, the renter is responsible for any damages or theft until the rental location opens again. A late fee of 50 SEK per vehicle and other equipment beyond the rental period will be charged.

Damage Liability

The vehicle and other equipment must be used carefully; usage outside of normal wear and tear is considered careless usage. The renter is responsible for replacing damages that occur to the vehicle and equipment due to careless usage according to the Swedish Bicycle and Sporting Goods Retailers' Association's recommended price list. If the product is not listed in the association's price list, the supplier's price list applies. Any labor costs will be charged at 500 SEK per hour. Visby Bike Rental is not liable for personal injuries or clothing damage that may occur during the rental period. It is not allowed to transport passengers on the luggage carrier.

If the vehicle or other equipment is stolen during the rental period, the renter will be responsible for its full value. If the renter has purchased theft protection at the time of pick-up, they will only be liable for a deductible, which is 500 SEK for bicycles, tandems, mountain bikes, cargo bikes, electric bikes, and hybrids, and 1500 SEK for bike trailers, provided that the vehicle and other equipment were locked at the time of theft, and the renter provides the key to the lock and a copy of the police report. If the vehicle and any additional equipment are found, they will be returned to Visby Bike Rental. The renter will never pay more than the applicable deductible with purchased theft protection. Theft protection can only be purchased at the time of pick-up/booking. Telephone number for the police in Visby: 114 14. The police report must be made by the renter personally. If theft protection has not been purchased and the vehicle and any additional equipment are found, the renter may instead pay rent for the period during which the vehicle and any additional equipment were missing, as well as any damages incurred, provided that an agreement is reached between the renter and Visby Bike Rental at the time of reporting the theft. In addition, the renter is required to pay a reward/retrieval fee of 200 SEK for the vehicle and any additional equipment.

Cancellation terms

In case of cancellation, a refund is allowed according to the following intervals;
Up to 8 days before the booking is valid - 100% Refund.
7-2 days before the booking is valid - 50% Refund.
1-0 days before the booking is valid - 0% Refund.

Cancellation protection

If you have added "Cancellation Protection (per vehicle)" at the time of booking, a full refund (100%) of the value of the booking is allowed up to 24 hours before the booking takes place.

Force Majeure

Force Majeure such as war, extensive labor dispute, blockade, fire, environmental disaster, serious spread of infection or other extent beyond the control of a party and which prevent a party from fulfilling its obligations and release a party from it. Such exemption applies provided that the business cannot be conducted under these conditions either. The other party shall be notified immediately of the circumstances which may apply this provision

Change of contract terms

After the customer has completed a purchase, the Sales Company does not have the right to change the terms of the current purchase unless otherwise agreed.

Disputes & Laws

Swedish law shall apply to all purchases in accordance with these terms and conditions. Disputes concerning purchases in accordance with these terms and conditions shall be tried exclusively by a Swedish general court.

Appendix 1, Personal data processing GDPR

Gotland By Bike AB, org. no. 559057-3233, processes personal data in connection with the trade at https://visbyhyrcykel.com and is responsible for personal data for the processing. Personal data is processed in order for Gotland By Bike AB to be able to provide its services, mainly for the following purposes ("Purposes"): 
• To create and maintain your personal account
• To receive and process your orders.
• To handle any returns.
• To send you SMS notifications about booking status.
• To answer your questions and inform you about new or changed services.
• To send marketing offers as newsletters.
• To send you surveys that give you the opportunity to influence Gotland By Bike AB's offers and services.

The data processed are the data you enter, e.g. when you place orders, contact customer service or the like. The information you enter includes e.g. contact information, delivery address and ordered goods ("Personal data"). The personal information is necessary for Gotland By Bike AB to be able to achieve the Purposes. Some information may also be obtained from public records or from other publicly available sources. 

The main legal basis for the processing is that the processing is necessary for Gotland By Bike AB to be able to fulfill its obligations to its customers. Some treatments are also based on Gotland By Bike AB's legitimate interest in being able to conduct its business in an efficient and safe manner and an obligation to comply with legal obligations. The personal information may be shared with authorities and other parties that Gotland By Bike AB uses to achieve the Purposes, e.g. for delivery. These actors may be based in countries outside the EU / EEA. If the European Commission does not consider that the country ensures an adequate level of protection, the transfer to the third party will be supported by the Commission's standard contractual clauses for the transfer of personal data to a country outside the EU / EEA, see Articles 45-46 of Regulation 2016/679 ("GDPR"). The processing of Personal Data will continue for as long as it is required to fulfill the Purposes or as long as Gotland By Bike AB is obliged to do so. The Personal Data is then deleted.

Your rights under the GDPR include the following:
• Right of access - According to Article 15 GDPR, you have the right to access the Personal Data and to be informed about the processing. That information is contained in this document.
• Right to rectification - According to Article 16 of the GDPR, you have the right to have incorrect personal data concerning you rectified without undue delay. Taking into account the purpose of the processing, you also have the right to supplement incomplete personal data.
• Right of deletion ("the right to be forgotten") - In certain circumstances, you have the right to have your Personal Data deleted pursuant to Article 17 of the GDPR.
• Right to restrict use - In certain circumstances, you have the right under Article 18 GDPR to restrict the processing of Personal Data.
• Right to data portability - According to Article 20 GDPR, you have the right to obtain the Personal Data in a structured, commonly used and machine-readable format. You also have the right to transfer this information to another personal data controller.
• Right to object - Under Article 21 of the GDPR, you have the right to object to certain processing of the Personal Data, such as such processing based on: Gotland By Bike AB:s legitimate interests.
